Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Alsaroukh applications and related services (the "Service"), operated by A.S Systems for Technology Solutions. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 18 years old to create a delivery captain or merchant account, and at least 16 years old to create a customer account. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account.
2. Terms for Customers
- Orders are placed through the app and fulfilled by independent merchants and delivery captains connected via the Service.
- Prices, delivery fees, and estimated delivery times are shown at checkout and may vary based on distance, demand, and merchant settings.
- Order cancellation is available only before a merchant accepts the order, or as otherwise permitted in-app; cancellation after preparation has begun may not be possible or may incur a fee.
- You are responsible for providing an accurate delivery address and being reasonably available to receive your order.
- Coupons, loyalty points, and referral rewards are subject to the specific terms and expiry periods displayed at the time they are issued, and may be modified or revoked in cases of abuse.
3. Terms for Delivery Captains
- Delivery captain accounts require application review and identity/document verification before approval; we reserve the right to approve or reject any application at our discretion.
- Captains operate as independent contractors, not employees of A.S Systems, and are responsible for their own vehicle, fuel, insurance, and compliance with applicable traffic and licensing laws.
- Commission is deducted from each completed delivery as disclosed in the app; earnings and settlement history are visible in your in-app wallet.
- Accounts with unpaid commission balances beyond the applicable grace period may be temporarily suspended until settled.
- Captains must handle orders, cash payments, and customer interactions professionally and in good faith.
4. Terms for Merchants
- Merchants are solely responsible for the accuracy of their product listings, pricing, availability, and food safety/quality where applicable.
- Merchants must accept or reject incoming orders promptly and prepare accepted orders within a reasonable time.
- Commission rates are disclosed in-app and may be customized per merchant at our discretion; settlement of merchant wallet balances follows the schedule and method described in the app.
- Sensitive profile changes (shop name, category, logo) may require administrative review before taking effect, to protect customers from misleading listings.
- We reserve the right to suspend or remove a merchant listing for repeated order rejections, quality complaints, or Terms violations.
5. Payments
The Service supports cash-on-delivery and, where enabled, electronic payment methods. All fees, commissions, and settlement amounts are calculated and recorded automatically by the platform. Disputes regarding a specific order or settlement should be raised through in-app support within a reasonable time of the transaction.
6. Prohibited Conduct
- Providing false identity, vehicle, or business information.
- Harassing, threatening, or abusing another user through in-app chat, calls, or in person.
- Attempting to circumvent the platform's commission or payment systems.
- Using the Service for any unlawful purpose, including the delivery of prohibited goods.
- Interfering with or attempting to reverse-engineer the Service's security or matching systems.
Violation of these rules may result in warnings, order restrictions, account suspension, or permanent termination.
7. Account Suspension and Termination
We may suspend or terminate access to the Service, with or without notice, for violation of these Terms, suspected fraud, non-payment of outstanding commission, or extended inactivity. You may delete your own account at any time via the in-app account deletion flow or the web Delete Account page.
8. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available". A.S Systems acts as a technology platform connecting independent customers, merchants, and delivery captains, and is not itself the seller of merchant products nor the employer of delivery captains. To the maximum extent permitted by law, A.S Systems is not liable for indirect, incidental, or consequential damages arising from use of the Service, including delays, order inaccuracies caused by a merchant, or conduct of an independent delivery captain.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date above.
10. Governing Law
These Terms are governed by the laws of the Republic of Iraq, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Iraq.
